§ 1 Scope and provider

These General Terms and Conditions apply to all orders placed by private individuals via the Anna Wirth online shop, Lilienweg 33, 41189 Mönchengladbach, Germany.


§ 2 Conclusion of contract

§ 2.1 The product representations in the online shop serve to submit a purchase offer. By clicking the “Order now” button, you are making a binding purchase offer. Our products are only sold for private use in normal household quantities.

§ 2.2 We can accept your order by sending an order confirmation by email or by delivering the goods within five days. Confirmation of receipt of the order does not constitute acceptance of the purchase offer.

§ 2.3 If our order confirmation contains typographical or printing errors or if our price determination is based on technical transmission errors, we are entitled to challenge the order, although we must prove our error to you. Payments already made will be refunded to you immediately.

§ 2.4 Our contract language is exclusively German. Using the functions of his browser, the buyer can save or print out the order data immediately before sending.


§ 3 Prices

The prices stated on the product pages include statutory VAT in accordance with Section 19 of the Ust. Act and other price components and do not include postage. The buyer is responsible for all additional duties and taxes, the majority of our shipments do not incur additional fees.


§ 4 Shipping costs

§ 4.1 The shipping costs are shown for each product.

§ 4.2 The buyer is responsible for all customs duties and taxes, there are no fees for most of our shipments.


§ 5 Delivery conditions and reservation of self-delivery

§ 5.1 The choice of supplier is at Anna Wirth’s discretion.

§ 5.2 Unless stated otherwise in the offer, the delivery time is approx. 1-3 weeks.

§ 5.3 If delivery of the goods fails despite three attempts to deliver, we can withdraw from the contract. Any payments made for the product will be refunded to you immediately. The payment made for shipping will be retained.

§ 5.4 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we can withdraw from the contract. In this case, we will inform you immediately and, if necessary, suggest delivery of a comparable product. If no comparable product is available or you do not wish a comparable product to be delivered, we will immediately reimburse you for any consideration that has already been paid.


§ 6 Payment conditions

§ 6.1 Payment can be made either in advance or Paypal.

§ 6.2 If you select the payment method in advance, we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account within 7 days. The stated delivery time of 1-3 weeks starts after receipt of payment.

§ 6.3 If you default on payment, interest will be charged on the purchase price during the default at a rate of 5% above the base interest rate. We reserve the right to prove and claim higher damages caused by the delay.

§ 6.4 You only have the right to offset if your counterclaims have been legally established by a court, are undisputed or have been acknowledged by us in writing.

§ 6.5 You can only exercise a right of retention if the claims result from the same contractual relationship.


§ 7 Retention of title

The goods remain our property until full payment has been made. Before ownership is transferred, pledging, transfer as security, processing or redesigning without our consent is not permitted.


§ 8 Right of withdrawal

§ 8.1 Consumers have a two-week right of withdrawal. Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts: Contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer are tailored.

Right of withdrawal

Consumers within the meaning of Section 13 of the German Civil Code (BGB) have a right of withdrawal according to the following conditions:

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. If several goods are ordered as part of a single order and they are delivered separately, the deadline is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods. The individual products must be related to each other.

To exercise your right of withdrawal, you must contact Anna Wirth, Lilienweg 33, 41189 Mönchengladbach, email:contact@anna-wirth.com, by means of a clear statement (e.g. a letter sent by post, fax, email) about your decision to revoke this contract. If you make use of this option, we will immediately send you confirmation (e.g. by email) of receipt of such a revocation.

Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts: Contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer are tailored. Contracts for the delivery of goods if, due to their nature, they were inseparably mixed with other goods after delivery.


Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For the repayment, we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods immediately and in any case no later than fourteen days from the day on which you sent your cancellation to us to Anna Wirth, Lilienweg 33, 41189 Mönchengladbach. The deadline is met if you send the goods before the fourteen day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.


General information

1. Please avoid damage and contamination of the goods. If possible, please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.

2. Please note that the aforementioned paragraph 1 is not a prerequisite for the effective exercise of the right of withdrawal.


§ 8.2 Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts: Contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to personal needs of the consumer. Contracts for the delivery of goods if, due to their nature, they were inseparably mixed with other goods after delivery.

§ 8.3 Please avoid damage and contamination. If possible, please send the goods back to us in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging in order to avoid claims for damages due to damage caused by inadequate packaging.

§ 8.4 Please send the goods back to us as a prepaid package and keep the delivery receipt.

§ 8.5 Please contact us by email:contact@anna-wirth.comto announce the return. In this way, you enable us to assign the products as quickly as possible.

§ 8.6 Please note that the modalities mentioned in paragraphs 8.3 to 8.5 are not a prerequisite for the effective exercise of the right of withdrawal.


§ 9 Returns and exchanges

To preserve the issue, all orders are final, no returns or exchanges. My work is made to order, so we cannot accept returns. If your print is damaged in transit, or in the very unlikely event that it arrives with a defect, we will replace it. In this case, contact us by email:contact@anna-wirth.com. We will ask you for some pictures or video of the damage so we can provide them to the shipping carrier.


§ 10 Transport damage

§ 10.1 If goods are delivered with obvious transport damage, please complain about such errors immediately to the delivery person and please contact us as quickly as possiblecontact@anna-wirth.com.

§ 10.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance company.


§ 11 Warranty

The warranty is subject to legal regulations.


§ 12 Liability

We exclude our liability for slightly negligent breaches of duty, provided that these do not relate to essential contractual obligations, damages resulting from injury to life, body or health or guarantees or do not affect claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents.


§ 13 Final provisions

§ 13.1 If a provision of these General Terms and Conditions is invalid, the rest of the contract remains valid. The relevant statutory provisions apply in place of the invalid provision.

§ 13.2 German law applies.
